GENERAL TERMS AND CONDITIONS OF TMYC YACHT CHARTER

1. Introduction

These Terms & Conditions govern all yacht charter services provided by TMYC Yacht Charter, based in Pattaya, Thailand.

By confirming a booking and making any payment, the client agrees to be bound by these Terms & Conditions.

2. Booking & Reservation

  • All quotations are indicative only and subject to availability.
  • A booking is only confirmed upon receipt of a deposit or full payment.
  • TMYC reserves the right to cancel any reservation if payment is not completed within the agreed timeframe.

3. Payment Terms

  • A deposit is required to secure the booking.
  • Full payment must be completed before the charter date.
  • Payments can be made via:
    • Bank transfer
    • Credit card / Stripe
    • Local payment methods (PromptPay, etc.)

4. Pricing & Additional Charges

  • Prices depend on:
    • Duration
    • Number of guests
    • Selected yacht
  • Additional charges may include:
    • National park fees
    • Marina fees
    • Extra activities (jet ski, banana boat, etc.)

5. Cancellation & Refund Policy

  • Cancellation terms depend on the timing before departure:
    • More than X days: partial refund
    • Less than X days: non-refundable
  • No-shows or late arrivals are non-refundable.

6. Weather Conditions

Charter services will proceed as scheduled under normal weather conditions, including but not limited to cloudy weather, light rain, or moderate sea conditions.

TMYC reserves the right to determine whether weather conditions are safe for departure.

Rescheduling or refunds will only be considered in cases of severe and unsafe weather conditions, including but not limited to:

  • Typhoons
  • Tropical storms
  • Government-issued warnings
  • Extreme sea conditions that pose a safety risk

In such cases, TMYC may, at its sole discretion:

  • Offer a rescheduled date, or
  • Provide an alternative arrangement, or
  • Issue a partial or full refund

No refunds or rescheduling will be provided for subjective or non-severe weather concerns.

7. Guest Responsibilities

Guests agree to:

  • Follow all safety instructions from the crew
  • Respect the yacht and equipment
  • Avoid dangerous or illegal behavior

TMYC reserves the right to terminate the trip without refund if safety is compromised.

8. Damage & Liability

  • Clients are responsible for any damage caused by negligence.
  • TMYC is not liable for:
    • Personal injury caused by unsafe behavior
    • Loss of personal belongings

9. Food & Drinks Policy

  • Outside food and drinks are allowed (except restricted items such as durian).
  • Clients must inform TMYC in advance if bringing external catering.

10. Insurance & Risk

  • Yacht charter activities involve inherent risks.
  • Clients participate at their own risk.
  • Travel insurance is strongly recommended.

11. Delays & Itinerary Changes

  • TMYC reserves the right to:
    • Adjust routes
    • Change itinerary
    • Replace yachts (if necessary)

12. Force Majeure

TMYC is not responsible for cancellations caused by:

  • Natural disasters
  • Government restrictions
  • Unforeseen external events

13. Use of Media

TMYC reserves the right to use photos/videos taken during the trip for marketing purposes unless the client requests otherwise.

14. Acceptance

By making a booking and payment, the client confirms that they have read, understood, and accepted these Terms & Conditions.
